Terms of Service

These Terms of Service ("Terms") govern your access to and use of zoexapps.com and the Shopify applications published by Byteex Ltd, a company registered in Cyprus (Gladstonos 16, Paphos, 8046, Cyprus), trading as Zoex Apps ("we", "us"), including Zoex Coming Soon (together, the "Services"). By installing one of our apps or using the Site, you agree to these Terms. If you use the Services on behalf of a business, you represent that you have authority to bind that business.

1. The Services

Our apps run on the Shopify platform and are subject to your agreement with Shopify. You need a Shopify account to use them; we are not responsible for the Shopify platform itself. We may add, change, or remove features of the Services at any time.

2. Fees

Where an app is offered free of charge, it is provided as-is under these Terms. If we introduce paid plans, pricing will be shown in the Shopify App Store listing and billed through Shopify's billing system; continued use after a price change constitutes acceptance.

You may not interfere with or disrupt the Services, attempt to access them by any means other than the interfaces we provide, probe or test their security without written permission, reverse engineer them except as permitted by law, or resell them without our consent.

5. Intellectual property

The Services, including their design, code, and branding, are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the apps on your Shopify store while these Terms are in effect. You retain all rights to your own content and data.

6. Privacy

Our Privacy Policy describes how we handle data across the Services and forms part of these Terms.

7. Availability and support

We aim to keep the Services available and to respond to support requests promptly, but we do not guarantee uninterrupted operation. Support is provided in-app and via support@zoexapps.com.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we do not warrant that a coming soon page will prevent all access to your storefront: it is a presentation layer, not an access-control system, and content may remain reachable by search engines or visitors without JavaScript. Use Shopify's storefront password for hard access control.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Services. Our total liability for any claim will not exceed the greater of the amounts you paid us for the Services in the twelve months before the claim or fifty (50) US dollars.

10. Indemnity

You will indemnify and hold us harmless from claims arising out of your content, your use of the Services in violation of these Terms, or your violation of applicable law.

11. Termination

You can stop using the Services at any time by uninstalling the app. We may suspend or terminate access if you materially breach these Terms or use the Services in a way that risks harm to us, Shopify, or others. Sections that by their nature should survive termination (including 5, 8, 9, and 10) survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use of the Services after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law rules, and disputes will be resolved in the courts of Cyprus.
